Terms and Conditions

These Terms and Conditions ("Terms") govern the access to and use of the software-as-a-service applications Patient SignIn and DocRooms (collectively, the "Services") provided by Anchor Software Solutions, located at 59 Rice Run, East Brunswick, NJ 08816, USA ("Anchor", "we", "us", or "our"). By creating an account, accessing, or using the Services, you agree to be bound by these Terms.
1. Eligibility and Authority
You represent and warrant that you are at least 18 years of age and that you have the legal authority to enter into this agreement on behalf of yourself or the entity you represent (such as a clinic, medical practice, or healthcare organization).
2. Description of Services
2.1 Patient SignIn
Patient SignIn allows clinics to collect patient sign-in information, including patient name and date of birth, through a patient-facing interface and to view sign-in records through a staff-facing web interface.
2.2 DocRooms
DocRooms provides a real-time visual display that allows clinic staff to associate room numbers with providers, enabling visibility into room utilization and patient flow within a clinic environment.
The Services are intended to support operational workflows and are not a substitute for professional medical judgment or clinical systems of record.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree to notify Anchor promptly of any unauthorized access or suspected security breach.
4. Acceptable Use
You agree not to:
- Use the Services for unlawful, fraudulent, or deceptive purposes.
- Interfere with or disrupt the integrity or performance of the Services.
- Attempt to gain unauthorized access to systems, data, or networks.
- Use the Services in a manner that violates applicable healthcare, privacy, or data protection laws.
5. Customer Responsibilities
You are solely responsible for:
- The accuracy of information entered into the Services.
- Ensuring that your use of the Services complies with all applicable laws and regulations, including healthcare and privacy obligations.
- Obtaining any required patient consents for data collection and display.
5.1 Healthcare Regulatory Compliance
Anchor acts solely as a technology service provider and does not provide medical services. You are responsible for determining whether your use of the Services requires compliance with HIPAA or other healthcare regulations and for entering into any required agreements.
6. Data Ownership
As between you and Anchor, you retain all rights to data entered into the Services. Anchor may process such data solely for the purpose of providing, maintaining, securing, and improving the Services, in accordance with the Privacy Statement.
7. Fees and Payment
Certain features of the Services may require payment. Fees, billing terms, and renewal details will be disclosed during the subscription or purchasing process. Failure to pay applicable fees may result in suspension or termination of access.
8. Intellectual Property
The Services, including all software, designs, trademarks, and documentation, are the exclusive property of Anchor Software Solutions and are protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.
9. Service Availability and Modifications
We strive to maintain high availability but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue parts of the Services with reasonable notice.
10. Disclaimers
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, Anchor disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, Anchor shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or business interruption, arising out of or related to the use of the Services.
12. Indemnification
You agree to indemnify and hold harmless Anchor from any claims, damages, or expenses arising from your use of the Services or your violation of these Terms.
13. Termination and Account Deletion
You may request termination of your account at any time by contacting Anchor at support@anchorsoftwaresolutions.com. Upon verified request, Anchor will deactivate the account and process deletion of associated personal data in accordance with the Privacy Statement and applicable legal obligations.
Anchor may suspend or terminate access for violation of these Terms or applicable law. Upon termination, access to the Services will cease, subject to applicable data retention obligations.
14. Refund Policy
All fees paid to Anchor Software Solutions are non-refundable. Anchor Software Solutions does not provide refunds, credits, or prorated reimbursements for any subscription fees, license fees, usage charges, or other payments, regardless of usage, cancellation, suspension, downgrade, or termination of services. Once access to the software or services is granted, all payments are final.
15. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
16. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the website or application. Continued use of the Services constitutes acceptance of the updated Terms.
